ASSIGNMENT OF COPYRIGHT
You have submitted a triku to Triku.com. By clicking on the "I Agree" button
below you are doing the following:
- You represent that you are the sole creator and owner of the triku you
submitted and that you therefore hold a complete and undivided copyright interest in the
triku. You represent that the triku submitted by you does not violate copyrights held by
any other person or organization, and you represent that the triku has not been published
elsewhere in substantially similar form.
- In return for Triku.com's promise to publish your triku on its web site you
hereby assign to Triku.com all right, title and interest in the copyright to the triku
submitted by you. The rights assigned by this assignment include but are not limited to
the right to publish, reassign, license, make copies, make derivative works, include the
work in compilations, receive income or royalties, make claims for damages, or assert any
other right granted under the United States or International copyright law.
- Triku.com will retain all royalties this triku may generate in any book,
compilation or form where it is part of a collection of triku. Triku.com agrees to pay you
75% of all royalties generated by this triku when it is merchandized individually (i.e.
when it does not appear as part of a collection, serial or otherwise, of triku).
- You promise to protect and hold Triku.com harmless from the claims of any
other parties who assert an interest in the triku submitted by you and to repay Triku.com,
or any successor in interest, for any costs, including attorney fees, incurred as a result of
claims of third parties arising from the publication or dissemination of the triku submitted
by you.
- You agree that in case of a dispute arising from this assignment or the
publication of your triku by Triku.com you may only bring an action in the following
venues: (1) if in state court, in the Circuit Court of Multnomah County, Oregon, or (2) if
in federal court, in the District Court for the District of Oregon in Portland, Oregon. To
the extent that any agreement contained in this assignment is governed by state law it
shall be governed by the law of Oregon. In any action to enforce or interpret the terms of
this agreement the prevailing party shall be entitled to reasonable attorney fees.
